Derrick Rose’s rape accuser purposefully withheld some texts messages from the defense that would have helped their case, because of that the Judge is considering declaring a mistrial.
The judge in the Derrick Rose rape trial just warned that he may declare a mistrial in the case — over allegations the accuser’s team did NOT turn over text messages that could help the NBA star.
The judge just ripped the accuser’s attorney in court — demanding the accuser prove she made an effort to turn over ALL of the text messages that were relevant to the case.
Rose’s lawyer claims she purposefully withheld certain texts that may prove the sex in question was consensual … and not rape.
The judge warned the accuser, “This is not a trivial matter” — and has ordered the accuser’s team to provide proof the texts were made available to Rose’s team.
The text that was deleted was sent to Rose about two hours before the alleged rape.
The accuser was upset that Rose wouldn’t have sex with her friend who she brought over earlier and in a second text after the alleged rape she asked Rose for money.
“She was mad at me babe. Why you have me bring a bitch and you ain’t finna [sic] f- -k her,” reads the 1:37 a.m. text from the accuser, 30, to Rose, 28.
In a second text, sent within 24 hours of the encounter, the woman asked Rose when he would be depositing cash in her bank account.
Both the accuser and her friend stated they had no interest in sex that evening, the texts that were withheld contradict that claim.
The accuser stated in her testimony that she doesn’t clearly recall what happened. She believe she was drugged or too intoxicated to give consent (she didn’t go to hospital so there is no toxicology report).
Rose says she knew exactly what she was doing, this is just an extortion attempt because she fell on hard times and he broke up with her.
