40-year-old Kansas man David Ostrom, is in a tight custody battle with his ex-wife and he feels that he’s running out of options. The final choice that he’s resorting to is a combat battle with his ex-wife with swords, according to CBS.
Ostrom filed documents in Iowa asking the court to grant him a “trial by combat.” He also wants the court to give him 12 weeks to get the swords ready for battle. His ex-wife’s attorney isn’t taking this request seriously at all as he is asking the judge to give Ostrom a psychiatric evaluation. He is not making a ruling on that due to irregularities on motions from both parties.
Ostrom made sure to explain why the sword battle is a great idea in court by saying “To this day, trial by combat has never been explicitly banned or restricted as a right in these United States.” He even said her lawyer can serve as a “stand-in fighter.”
You can’t make this stuff up. At this point, it looks like Ostrom will just have to fight his custody battle the normal way in court without using any powerful swords. Flip the page for CBS news video regarding the request.
