An Ex-Business Associate Counter-sued Emmitt Smith for Fraud

The NFL veteran has been countersued by one of his former business associates, who claims the former running back cheated him.

Smith first filed a lawsuit against Johnny Wimbrey in December 2024, claiming that he gave hundreds of thousands of dollars to Wimbrey and a number of other defendants for investment. However, Smith now says the money was “misappropriated for other purposes.”

Wimbrey, however, filed a complaint against Smith this week, claiming that the legendary Dallas Cowboys player was the real source of the monetary losses.

In his counterclaim, Wimbrey contends that Smith “misrepresented to third parties that he had authority to act on behalf of Wimbrey and to use Wimbrey’s name and reputation in connection with soliciting or pooling investments.”

“These unauthorized syndications created liability exposure for Wimbrey, damaged his reputation, and wrongfully tied him to transactions and representations he did not authorize.”

He “suffered reputational damage, incurred legal expenses and sustained other financial losses” as a result of Smith’s activities, according to Wimbrey, a close family friend.

In the countersuit, he is requesting damages that are not defined. Smith’s lawyer has been contacted for comment on the situation, but we have not received a response as of yet.
