It is very difficult to prove someone raped you when you were so intoxicated you can’t remember the events of the evening. Not saying that it couldn’t happen, but it becomes he said versus she said.

According to Andrew Baggarly of CSN Bay Area, the Panda voluntarily met with authorities on Friday to discuss what he claims to be a consensual personal relationship of a sexual nature.

The alleged incident took place at the Seascape Beach Resort in Santa Cruz County. The alleged victim did not initially call police, but reported the incident later that day and claimed that she was too intoxicated to give consent

Sandoval has not been charged at this point and the investigation is still ongoing. According to Baggarly’s report, the alleged victim did allow medical staff to perform a sexual forensic evidence kit at an area hospital.

The question begs if you are so drunk that you can’t remember anything, does that mean you can’t consent to sex?

That is something for the police to determine.
