Cardell Hayes’ attorney has already implied that his client shot Will Smith in self-defense. There were witnesses at the scene that stated Smith threatened Hayes with a gun.
At the time the cops said they had only recovered one gun at the scene (Hayes’ gun), but they are now saying according to TMZ that Smith indeed had a loaded gun in his car.
The New Orleans PD says a fully loaded 9mm handgun was recovered from Will Smith’s car after he was fatally shot.
The discovery will undoubtedly help the defense — with at least one witness claiming Smith threatened to go to his car and get his gun during an argument moments before the shooting.
Hayes shot Smith in the back and Smith’s gun was never fired. Hayes contends that he believed Smith was going for his weapon when he fired the fatal shots.
Cops also stated Hayes had an additional gun in his vehicle that was not that murder weapon and was never fired.
