Former NFL quarterback Mark Sanchez has agreed to plead guilty in the Indianapolis alley fight that left him stabbed and a 69-year-old truck driver injured, court filings show, as both sides asked a judge to cancel next week’s jury trial.
Prosecutors and Sanchez’s attorneys filed a joint motion Thursday in Marion County Superior Court 21 seeking to vacate the Sept. 8 trial and schedule a guilty-plea and sentencing hearing for Nov. 9 or Nov. 16, according to WTHR-TV, which obtained the filing.
“The parties have reached a resolution that will obviate the need for the jury trial,” the motion said.
A judge still must accept the plea. Thursday’s filing did not specify which of the pending charges Sanchez intends to admit.
Sanchez, 39, is charged with a Level 5 felony count of battery resulting in serious bodily injury and three misdemeanors: battery resulting in injury, public intoxication and unlawful entry of a motor vehicle. A conviction on the felony alone carries a possible sentence of one to six years in prison and a fine of up to $10,000.
Nick Sanchez Jr., the former quarterback’s brother and legal adviser, called the development a step toward closing the case.
“This is a positive development. We are finalizing an agreement with the prosecutor’s office that provides a path toward resolving the state’s case,” he said in a statement obtained by ABC News. “We’re also encouraged by the constructive conversations taking place regarding the related civil matter. There is real momentum toward bringing this entire chapter to a close.”
The criminal case stems from an early-morning confrontation on Oct. 4, 2025, in a downtown Indianapolis alley near the Westin hotel and Loughmiller’s Pub & Eatery. Sanchez was in town to work the following day’s Las Vegas Raiders-Indianapolis Colts game for Fox Sports.
Police and court records say Perry Tole, then 69, was collecting used cooking oil from a loading dock when Sanchez approached and an argument over the truck escalated. Tole told investigators Sanchez entered the vehicle without permission, then became physical. Tole said he used pepper spray and then a knife after believing Sanchez was trying to kill him. Sanchez was stabbed multiple times in the upper torso and taken to a hospital in critical condition before being upgraded to stable. Tole suffered a deep laceration to his face.
Prosecutors charged Sanchez, not Tole. Officials said hotel surveillance and Tole’s account were consistent, and Tole was not charged. Sanchez told police he remembered nothing of the incident.
Marion County Prosecutor Ryan Mears said at the time that the situation “did not need to occur” and later upgraded the case after reviewing Tole’s injuries and age.
The trial date had been continued five times, most recently from July to Sept. 8. Fox Sports fired Sanchez in November 2025 after the arrest.
Tole has a separate civil lawsuit pending against Sanchez and Fox Corporation, alleging assault and negligent hiring. An amended complaint later added Huse Culinary Inc., operator of St. Elmo Steak House, on claims the restaurant over-served Sanchez. A federal judge later dismissed Huse from the case; claims against Sanchez and Fox remain. Tole’s attorney, Matt Golitko, said Thursday that talks with Sanchez’s team have been “productive” and that the parties are “on a positive path toward an agreement.”
Sanchez, a former USC and New York Jets quarterback who also played for the Philadelphia Eagles, Denver Broncos and Washington, has not publicly commented on the latest filing. Sentencing, if the plea is accepted, would not come until November.
