Donald Sterling V. Stiviano

Ever since the recordings were released, people argued about the legalities of them. It is illegal to secretly record someone and you can go to jail for it.

So, why hasn’t Donald Sterling called the cops on V. Stiviano? Because he allegedly gave her permission to record him according to TMZ.

A source connected with V. Stiviano tells TMZ Sports … the full conversation lasted approximately 1 hour. We’re told Stiviano insists it was clear to Sterling at the beginning of the conversation he was being recorded.

What’s more … our sources say Stiviano routinely recorded her conversations with Sterling as HIS “archivist.” And what’s more … she would regularly play the tapes back to him because he would often forget what he had said.

Our sources say sometime after the tape was recorded on April 9 … Stiviano and Sterling got in an argument because he wanted her to sign a confidentiality agreement … which she would not.

Depending on what is on the other recordings and what Stiviano decides to leak, Sterling who is already drowning in a sinking ship won’t be able to save himself.

  1. While Sterling is a POS, Vanessa may still be held liable. California requires explicit consent, not implied consent. Prior custom won’t hold. Especially if circumstances have changed. If she doesn’t have consent in writing and she is the ex, plus she is in a lawsuit, Sterling can easily say she no longer had a relationship that implied consent. If he didn’t consent at the beginning of the conversation, she still may get sued for damages of releasing private information.
