Although rape charges were dismissed for lack evidence against Florida State QB Jameis Winston, Erica Kinsman’s attorney, John Clune, has prompted FSU to open a Title IX investigation against Winston. In fact, Clune stated he was pretty confident that the school would be bringing code of conduct charges against Winston when the dust settled from the investigation.
“They assured us that the Title IX process was going to move forward,” said John Clune, a Title IX attorney representing the woman. “The interview went pretty well. I think it was a positive experience, and everyone felt like the university was taking it very seriously. We expect that there will be code of conduct charges that will be brought,” he said. “There’s no basis not to bring those charges now.”
However, it appears that a Title IX investigation of Winston already happened, as required by Title IX laws. Kinsman was also interviewed by the university last month. Winston’s attorney fired back his thoughts on the situation.
“The real story here is that after her Colorado attorneys created a media frenzy alleging that Florida State University failed to comply with its Title IX obligations, Ms. Kinsman had to come clean and admit that she previously refused to cooperate with the university’s Title IX inquiry.
“Now that she has finally done her Title IX interview, this is the fourth time Ms. Kinsman has told her story. We anticipate the same conclusion that followed her previous three statements to the Tallahassee Police Department, Florida State Attorney’s Office and in the FSU Code of Student Conduct hearing. Jameis Winston did not sexually assault Ms. Kinsman.”
On the other hand, Kinsman’s attorney is blaming internal issues for a lack of a swift process, and not his client’s allegedly refusal to cooperate with the Title IX process. If charges are brought against Winston, he faces the chances of being suspended from the football team and, more seriously, possible expulsion from school.
